INFORMATION ABOUT THE WEBSITE PRIVACY POLICY
Notice pursuant to EU Regulation 2016/679 ("GDPR")
Definitions
This document identifies the website https://clochardcorp.wixstudio.io/entertainment as the "Platform," Clochard Corp. as the "Data Controller" (currently without a VAT number, which will be created when revenues justify it), whose legal address is in the process of formalization, and the contact email is clochardentertainment@gmail.com, and the "User" as any individual who accesses and uses the Platform.
Types of Data Collected
When the User uses the Platform’s services, they agree to the collection of certain personal data by the Data Controller. This notice aims to summarize what data is collected, the reason for its collection, and how it is used.
The Data Controller processes two types of data:

Data Provided by the User
For private individuals, registration requires providing certain data necessary to access the Platform’s services. For example: nickname, email, and password for the website. Name, surname, address, city or town of residence, and phone number are necessary for the delivery of purchases.
For professionals, registration requires providing specific data for accessing services related to the Platform and particularly for handling potential collaborations, further detailed on the Bio & FAQ page (e.g., company name, VAT number, contact person, email, phone number, full address).
Data Collected Automatically
The data collection process involves technical data (e.g., IP address, browser type, information about the User's device, and approximate current location of the tool being used) and data collected through cookies or similar technologies. Since the site is built with Wix, reference is made to their privacy policy if they are involved in collecting such data on sites built on their platform. Clochard Corp., however, does not use or have access to this data. The Data Controller is interested only in the data entered by the User to facilitate the exchange of opinions, recipes, and literary products.
1. Use of Collected Data
The data is collected to provide services related to the Platform (e.g., product purchases, communications regarding the service, customer service contact, financial, administrative, or accounting activities), to inform Users about commercial initiatives linked to the products (e.g., surveys or quizzes), and, where consent is provided, to inform the User about promotional activities related to events, initiatives, or partnerships via email. Providing personal data is mandatory only for the treatments necessary to deliver the products offered by the Platform (refusal would make it impossible to use the service); it is optional for promotional and profiling purposes.
2. Data Processing Parties
The collected data may be communicated to companies performing functions directly connected and instrumental to the operation—both technical and otherwise—of the website services, such as storage, administrative, payment, and billing services, and to administrative and judicial authorities as required by law. In no case will the Data Controller sell or share personal data with third parties.
3. Access to Personal Data and Revocation of Consent
The User's personal data is accessible in their private area. To export or delete their personal data, Users are invited to contact the Data Controller through the available contact channels. Data will be exported within 30 days, unless the case is more complex, in which case a maximum period of three months is provided. Deletion will be done within the timeframes set by technical requirements and in accordance with the retention period.
4. User Rights
Users can exercise the following rights concerning their processed data:

Obtain the deletion or removal of their personal data;

Receive their data or have it transferred to another controller (the "take-out" right).
To exercise their rights, Users can send a request to the contact details of the Data Controller listed in the document. Requests are free and will be processed by the Data Controller as quickly as possible, in any case within 30 days.
5. Data Storage Methods and Times
Data is stored in paper and/or electronic/informatics form for the time strictly necessary to achieve the purposes outlined in section 1, in compliance with the User's privacy and applicable laws. For analysis purposes aimed at the development and improvement of the service, the User's personal data may be stored for up to 36 months. For direct marketing purposes, data is stored for a maximum period allowed by applicable law. Invoices, accounting documents, and transaction data are stored for 11 years according to legal obligations (including tax obligations). If the User exercises the right to be forgotten and requests the deletion of their personal data, it will be retained in a protected form with limited access only for crime investigation and prosecution purposes for no more than 12 months from the request date. Afterward, the data will be securely deleted or anonymized irreversibly.
For the same purposes, data related to online traffic, excluding communication content, will be stored for a period not exceeding 6 years from the communication date, as per Article 24 of Law No. 167/2017, which implements EU Directive 2017/541 on counter-terrorism.
6. Security
Data is collected by the parties indicated in section 2, following the relevant regulations, with particular attention to the security measures provided by the GDPR (Article 32) for processing with computer, manual, and automated tools, using methods strictly related to the purposes outlined in section 1 and ensuring the security and confidentiality of the data.
7. Changes
The privacy policy may be subject to changes over time. If there are substantial changes in how the Data Controller uses the User’s data, the Data Controller will notify them by publishing updates on their pages or through other similar means. The latest version of the policy is dated May 31, 2024.
8. Intellectual Property
All content on the Platform is protected by copyright law. The download of documents, images, and other files from the Platform is permitted only for personal and non-commercial use. Any such use requires citing the source from which the content was taken.
